Undercover officers from the Wayne County Sheriff’s Department saw Ferguson committing a lewd act with a sex worker at around 7.15am on Wednesday, according to the law enforcement agency.

When deputies approached him, Ferguson asked if they could “help him out” and told them his position, Captain Jason Bates said.

“At that time, Mr Bryan Ferguson stepped out and identified himself as a Detroit police commissioner,” Bates told Fox 2 Detroit.

“A title or position doesn’t make them above the law.”

Ferguson was handed a misdemeanor citation for indecent or obscene conduct involving a sex act with a prostitute, the police captain said.

The sex worker was also cited.

Ferguson told the Detroit Free Press that the allegations were a “big misunderstanding” and that he “has nothing to hide.”

“I’m done talking about it, that’s just not what happened,” he said.

He claimed that he didn’t know the woman and that she went into his vehicle and “just pulled up right on me,” the newspaper reported.

“This is rough. This is rough to tell. Because now I’m going to have this conversation with my family,” he said.

Ferguson had previously served as the chair of the city’s police oversight board.

He announced his resignation from the board, an 11-member civilian group that oversees the Detroit Police Department, a day after the incident.

“It has been an honor and a privilege to serve the residents of Detroit in police oversight,” Ferguson wrote in a statement.

“After further consideration of the best interest of my family and the Board, I am choosing to resign as District 1 Police Commissioner effective immediately.

“Again, I admonish the Board and the public to remain focused on the important work of oversight, transparency, and accountability."

The Detroit Police Department issued a statement on the situation, saying: “We were made aware that a member of the Board of Police Commissioners (BOPC) was cited by the Wayne County Sheriff's Office (WCSO) for an alleged illegal activity, which occurred this morning.

“We have not seen the police report and do not have details on the incident. Therefore, it would not be appropriate to comment. We will consult with the City of Detroit Law Department, regarding this matter.”

According to his bio on the Detroit Police Commission’s website, Ferguson graduated from the Detroit Citizens Police Academy in 2014.

He was elected to serve as the representative for district one in 2021.
